MO Jury Awards $781,000 in BOP Suicide
On July 7, 1998 a federal jury in Missouri awarded the estate of a federal prisoner $781,000. William Chilton was serving a 30 month sentence for bank fraud. When he entered the federal prison system he was taking Desryl and Xanax to treat his depression. After being transferred to FCI Jessup in Georgia, BOP psychiatrists took him off those medications and placed him on different medications, despite his requests to continue the previous medication. Chilton hung himself in his cell shortly afterwards. His estate filed suit claiming the BOP was deliberately indifferent. The case settled for a confidential amount while the case was on appeal. Plaintiff was represented by St. Louis, Missouri lawyers George Simmons and Michael McKitrick. See: Chilton v. USA, USDC EDMO, Case No. 4:96CV-02533.
