D.C. Prisoner Assaulted by Guard Settles Claim for $17,500

On February 24, 2004, plaintiff Emmett Spencer-El settled his federal 42 U.S.C. § 1983 claim against the District of Columbia, the D.C. Department of Corrections and guard C. Everett for $17,500.

Spencer-El claimed that on March 28, 2001, while in the custody of the D.C. DOC, he was physically assaulted by guard C. Everett. Spencer-El claimed that after a verbal altercation with the guard he was ordered to step behind closed doors. Everett then hit Spencer-El in the face with a pair of handcuffs and punched him under the left eye, dropping him to the floor. Everett then stomped and kicked Spencer-El in the head, shoulders, and back.

Spencer-El filed suit in the U.S. District Court for the District of Columbia, Civil Division. The case settled prior to trial for $17,500.
