  Washington DOC Agrees to Pay $1,000 to Prisoner Who Fell from His Bunk
  
  
  
    On July 10, 2007, the State of Washington agreed to pay $1,000 to a prisoner who fell from his bunk. 
Jody Allen Miller was assigned to a lower bunk at the Wall Walla Washington State Penitentiary during intake for medical reasons. Miller was initially placed in a lower bunk, but was later ordered to move to an upper bunk in order to accommodate another prisoner who also had a lower bunk requirement.
Miller showed two Department of Corrections guards paperwork that reflected his need for a lower bunk. However, both guards refused to move Miller to a lower bunk. Miller subsequently fell from his upper bunk, injuring himself.
Miller filed a tort claim about the matter. The State agreed to settle the claim for $1,000.
