Pennsylvania DOC Settles Accommodation Suit

On July 19, 2010, the Pennsylvania Department of Corrections (DOC) agreed to pay $2,000 to a Pennsylvania state prisoner who sued after he was denied access to certain religious publications.

Basil Allah Yates, a member of the Nation of Islam, sued the DOC after the Incoming Publication Review Committee refused to allow Yates to receive several different NOI related publications.

The settlement requires the DOC to deposit $2,000 into Yates' prison account. In addition, the settlement requires the DOC to provide Yates with the following publications: (1) Tricknology of the Enemy; (2) The Announcement; (3) History of the Nation of Islam; (4) How to Eat to Live, Vol. 1 & 2; (5) The Theology of Time; (6) 7 Speeches; (7) The Flag of Islam; (8) The Meaning of NOI; and (9) The Supreme Wisdom Volume I & II. Yates represented himself in the case. See: Yates v. Painter, U.S.D.C. (M.D. Penn.), Case No. 3:09-cv-00899-WJN-DB.
