$250,000 Award to Crime Victim under NY Son of Sam Law
A New York jury awarded $250,000 to the victim of a sexual assault against the estate of the prisoner who committed the crime. The victim sued after the prisoner’s estate successfully pursued a medical negligence claim against the State.
The prisoner died from cardiac causes. The victim sued under the “Son of Sam” law that allowed her to proceed against assets, irrespective of the absence of any relationship between the crime and the monies received on behalf of the offender. Under the “Son of Sam” law, the statute of limitations begins once the offender or the offender’s estate receives the money. The jury verdict occurred in May 2004.
