$40,000 for DUI Suspect over Destroyed Exculpatory Video
A jury in the United States District Court for the Western District of Wisconsin decided, in December 2009, in favor of plaintiff Troy Scheffler in the amount of $40,000 for the county willfully destroying an exculpatory video recorded at the county jail in a DUI case. At trial the county admitted destroying the video.
The jury found that the county knowingly denied Scheffler the video and awarded him $15,000 for emotional distress as compensatory damages, and $25,000 in punitive damages for the arbitrary and capricious action of the county.
