$25,000 Settlement for CCA Prisoner Assaulted After Guards Open Cell Door
$25,000 Settlement for CCA Prisoner Assaulted After Guards Open Cell Door
by David M. Reutter
Corrections Corporation of America paid $25,000 to settle a lawsuit alleging guards at the Silverdale Detention Center opened a prisoner’s cell door allowing him to be assaulted.
Prisoner Jeremy Cross was celled with prisoner Eric Smith. In February 2011, Smith was involved in an altercation with other prisoners, and guards returned Smith to his cell with Cross.
The complaint alleged that at around 4 a.m., a guard opened Cross and Smith’s cell door, allowing several prisoners who were involved in the altercation to enter the cell. An assault then ensued, causing Cross to sustain a broken elbow, contusions and a head wound requiring 15 staples.
Cross agreed to the settlement on September 29, 2012. He was represented by attorney Bill W. Pemerton. See: Cross v. Corrections Corporation of America, Circuit Court of Hamilton County (Tenn.), Case No. 11C1543.
