$7,000 Settlement for CCA’s Negligence Causing Prisoner’s Broken Arm

Corrections Corporation of America paid $7,000 to settle a negligence lawsuit stemming from a prisoner falling off a bunk. During his intake at CCA’s Silverdale Detention Facility, prisoner Jeremy Shinn informed guards that he had a pre-existing shoulder injury.
Guards said he would be assigned to a low bunk, but he was placed on a top bunk. On his first night at the prison, July 22, 2009, Shinn fell from the top bunk and tried to protect himself with outstretched hands. He heard an audible “pop” and felt pain in his left wrist. Guards made him wait over an hour before they took him to a clinic.
At the clinic, X-rays were not taken and he was not provided any other care. Upon his release five days later, Shinn went to a hospital, which found his left distal radius was fractured. His suit alleged negligence and failure to provide medical care.
