CCA Pays $25,000 in Wrongful Death of Overweight Tennessee Prisoner
Corrections Corporation of America (CCA) paid $25,000 to settle a lawsuit involving the death of a prisoner at the Silverdale Detention Center in Tennessee.
When received by CCA, prisoner Freddie Lindsey Lightner, Jr. weighed approximately 650 pounds and was able to ambulate unassisted. By January 5, 2002, he was unable to ambulate or care for himself, including his personal hygiene. CCA made him “lie in his own waste for an indeterminate period of time and [did] not provide[] adequate help to assist in his hygiene,” states the complaint.
CCA also failed to assure that he would not develop pressure sores and then failed to treat the multiple pressure wounds that developed. He was not taken to a hospital until January 21, 2002, and then later died.
The February 2004 confidential settlement agreement was obtained by PLN via a public records request. Lightner’s estate was represented by Nashville attorneys Julian T. Bolton and David A. McLaughlin.
