Settlement Reached in Beating at California Youth Correctional Facility
A settlement was reached in a lawsuit alleging guards beat a prisoner at California’s N.A. Chaderjian Youth Correctional Facility after he refused to sign a “contract” admitting that he was a gang member.
On January 20, 2004, immediately after prisoner Vincent Baker’s refusal to sign, guards Delving Brown, Marcel Berry, Daniel Torres, Linda Bridges, Stevie Chu, and Robert Dutra assaulted and battered Baker by “repeatedly striking him about his face and body with their fists, kicking him with their feet in the face and…body, ‘spraying’ him with chemical agents (including pepper balls and mace), [and striking Baker] with knee drops to the back of the [his] head, neck, and kidneys.”
As a result, Baker suffered “severe and permanent injuries to his body and nervous system, mental suffering,” damages from medical expenses, past and future, and loss of earning capacity. The complaint charged claims of assault and battery, fraud and concealment for filing false written reports, and conspiracy. It also alleged violations of Baker’s constitutional rights.
A settlement agreement was reached on April 13, 2007. This action was originally filed in state court and then transferred to federal court.
