$1.15 Million Paid by New York’s Clinton County in Class Action
New York’s Clinton County agreed to pay $1.15 million to settle a class action that alleged the county violated the rights of arrestees booked into the county’s jail. The suit alleged that the jail’s blanket policy of strip searching everyone booked into the jail violated their Fourth Amendment Rights.
“The policy of Clinton County and the Clinton County Sheriff’s Department forcing those charged with minor crimes to undergo the indignities of a strip-search…is not only clearly illegal but degrading, incentive, and unnecessary,” the lawsuit agreed.
The suit was brought in 2006 by Phyllis Mitchell, who was subjected about three years earlier to a visual strip search after her arrest on several misdemeanor charges for violating agriculture laws. The suit was settled in June 2009. The class was represented by attorney Robert Keach.
