$999.99 Settlement for Excessive Force against CCA Prisoner
Corrections Corporation of America paid $999.99 to settle a lawsuit by prisoner Timothy Groce, who alleged guards used excessive force upon him at Whiteville Correctional Facility.
Groce refused to remove his arm from his segregation cell “bean flap” on March 18, 2010, until he received medical attention for vomiting blood. Guard James McVey gave him a direct order to remove his arm, and as Groce did so, he slammed the flap on Groce’s hand. In response, Groce made disrespectful comments and threatened to spit on McVey.
That prompted McVey to place Groce on property restriction and then handcuff Groce, after he tried to spit on him. McVey also yanked Groce’s arm through the “bean flap” and threatened to break his arm. The move caused contusions and swelling. Later, McVey threatened to pepper spray Groce and then left him in the shower for several hours.
Groce agreed to the settlement on September 14, 2013. Groce proceeded pro se. See: Groce v. Dotson, U.S.D.C. (W. D. Tenn.), Case No. 1:10-cv-01224.
