$350,000 Settlement in Florida Prisoner’s Negligence Claim, Failure to Correct Dangerous Condition
The Geo Group, Inc., Florida Correctional Finance Corporation, South Bay Correctional Facilities Financing Corporation and the Florida Department of Corrections paid $35,000 to settle a prisoner’s negligence claim. The settlement came in a lawsuit filed by prisoner Edward Milner.
In his amended complaint, Milner alleged that the Defendants created a dangerous condition by having dug a hole in a common area, the prison’s recreation yard. The hole had been allowed to remain uncovered and unattended for a sufficient length of time with no adequate warning being issued to Milner, and that by inadequately supervision, maintaining, controlling the premises or taking proper precautions, they failed to prevent and protect him from sustaining injury by tripping and falling into the hole on May 27, 2004.
On September 27, 2009, Milner accepted a $35,000 settlement. Milner was represented by Ft. Lauderdale attorney Lawrence J. Bohannon. See: Milner v. The Geo Group, Inc., Fl. 17th Judicial Cir. Court, Case No. 06-005582.
