Pro Se Prisoner Wins Property Claim in California Court
Thomas J. Stahley of California's Salinas Valley Prison unit was placed in administrative segregation on January 17, 2006. The property officer lost his tennis shoes, a pair of Levi jeans and five compact discs. He filed suit in Sacramento's Superior Court, seeking an order to the prison to return the items or compensate him for their value pursuant to state law.
The state never responded. The court clerk entered a "peremptory writ of mandate” in Stahley's favor on February 6, 2009, followed by a second order in Stahley's favor by a Superior Court Judge.
