Ohio Guard Added to Sex Offender List and Sent to Prison for Sex with Detainee
A former guard at the Highland County jail in Ohio was sentenced to 24 months in prison and lifelong registration as a Tier III sex offender for engaging in sexual activity with a female prisoner at the detention facility where he worked.
Robert Diskete was hired at the Highland County Justice Center in 2020 and was still under his probationary term when he was indicted for sexual conduct with a female prisoner between the dates of July 19, 2020 and October 14, 2020. He was immediately released from duty after being indicted. Assistant prosecutor Adam King said he was requesting a term of years of incarceration.
The relationship had not been discovered until after the prisoner was released. She was enrolled in the STAR program. In this program, all phone calls are monitored. That is when officials became aware that a crime had been committed. Once notified, the neighboring Jackson County Sheriff’s Office opened an investigation on Diskete and charges soon followed.
Diskete’s attorney, Mark Jon Wieczorek requested the court not impose any imprisonment, only probation. Wieczorek said the severity of Diskete’s sex offender registration was punishment enough. “This is a lifetime registration,” he stated. “That in itself is punishment for the rest of his life.”
Judge Cross said that Diskete appeared to be a God fearing, law-abiding man. “Unfortunately,” he said, “you committed a very serious offense.” He said Diskete violated the trust of the sheriff and public officials, undermined security, and set the County up for possible litigation. In May, Diskete was sentenced to 24 months at Correctional Reception Center in Pickaway County, Ohio.
“I feel bad for your family,” said Cross. “They didn’t commit the crime, but unfortunately they have to pay a price.”
