Chaney, General Counsel Central Office We have just been informed that Miller ~ Clark, 90-3713-WLB, FILS has been set for trial on June 30, 1992 in East st. Louis. This action involves an inmate that transferred to the USP Marion from a facility where he utilized common fare in satisfaction of his dietary requirements under the Eckankar reliqion. Upon arrival at Marion the inmate discovered common fare was not available and he requested a Kosher diet. He was initially denied the Kosher diet on the basis he was not Jewish and-did not sincerely embrace those religious beliefs. The court required the inmate to demonstrate exhaustion of administrative remedies on the matter as well as show a sincerely held belief in Judaism. Subsequently, the inmate wae interviewed by the institution Rabbi and it was concluded the inmate was sinoere 1n his desire to convert and adopt the tenants of the Jewish religion. Collaterally, the inmate exhausted his administrative remedies and was allowed to utilize a Kosher diet. The inmate was not satisfied with this relief and continues to request damaqes for the . period of time he contends he was wrongfully denied a Kosher diet.
