IN A SHORT DECISION, JUDGE MCCLURE GRANTS SUMMARY JUDGMENT IN FAVOR OF NUMEROUS USP LEWISBURG SORT TEAM MEMBERS. THE INMATE HAD ALLEGED EXCESSIVE USE OF FORCE IN A FORCED CELL MOVE IN FEBRUARY 1990. THE JUDGE RELIED HEAVILY ON THE VIDEOTAPE EVIDENCE OF THE CELL MOVE. THE JUDGE FOUND THE TAPE WAS "IRREFUTABLE EVIDENCE THAT DEFENDANTS DID NOT VIOLATE PLAINTIFF'S EIGHTH AMENDMENT RIGHTS." THIS CASE UNDERSCORES THE IMPORTANCE OF VIDEOTAPE EVIDENCE IN DEFENDING USE OF FORCE CASES. 2. SMALL V. SKEDZIELEWSKI, 92-3945 (DNJ FEB. 26, 1993) INMATE SMALL, 12377-056, BROUGHT BIVENS ACTION AGAINST SUPERVISOR OF EDUCATION AND WARDEN AT FCI FAIRTON. INMATE ALLEGED THAT HE WAS REFUSED PARTICIPATION IN PELL GRANTS BECAUSE OF AN INS DETAINER AGAINST HIM. THE INMATE ALLEGED VIOLATION OF EQUAL PROTECTION.
