Hayes, Jr. Acting Director Office of Detention and Re MEMORANDUM FOR: FROM: j fV b6,b7c b6,b7c Reviewer-In-Char;p Culberson County Jail Annual Detention Review SUBJECT: Creative Corrections conducted an Annual Detention Review (ADR) of the Culberson County Jail, located in Van Hom, Texas, on August 7-8,2008. The facility is operated by the County of Culberson, Texa As e attached documents, my team of Subject Matter Experts b6,b7c b6 (SME) included rity SME for Health Services; b6 b6, b7c 5MB for Safety; and , 5MB for Food Services. A closeout meeting was conducted on August 8, 2008, with Sheriff Oscar Carrillo. The closeout included a discussion of all concerns and recommendations"noted during this review. Type of Review: This review is a scheduled Detention Standard Review to detennine general compliance with established ICE National Detention Standards for facilities used for wtder 72 hours. Review Summary: The Culberson County Jail is not accredited by the National Commission on Correctional Health Care (NCCHe), the American Correctional Association (ACA), or the Joint Commission on Accreditation of Healthcare Organizations (JCARO). Standards Compliance: The following statistical information provides a direct comparison of the 2007 ADR and this ADR conducted for 2008. . The following deficiencies were cited in that report: Detainees have access to knife cabinet; a detainee was observed securing the cabinet. No Material Safety Data Sheets were available. Not all smoke detectors were operating properly and fire extinguishers were not checked monthly. A detainee was observed in the control center and dispatcher area. The facility does not maintain a log for incoming or departing vehicles and such vehicles were not searched upon entry/exit. During the 2008 review, we closely examined the above issu~s, to find: Knives shadowed in a locked cabinet with only staff access; knives in use were cabled to the workstation. There were Material Safety Data sheets for every product, neatly filed and readily accessible. Smoke detectors were found operational and monthly fire safety inspections were conducted (including fire extinguishers). Detainees are prohibited from the-controUdispatch area. The 2007 Reviewers concern regarding vehicle inlout searches and logging is tUlclear. There is no vehicle entrance into the secure perimeter. The only vehicle area we noted was a public parking area that not only served the jail but also the court and tax office. It is evident that significant effort was put forth to correct previous deficiencies. The Sheriff was very receptive to our recommendations and it is anticipated that he will implement those changes. Recommended Rating and Justification It is the Reviewer-in-Charge (RIC) recommendation that the facility receive a rating of "Acceptable." As no deficiencies were identified, a Plan of Action is not required. RECOMMENDED RATlNG: o SUPERIOR o GOOD o I:8J ACCEPTABLE DEFICIENT OAT-RISK COMMENTS: In January 2008, a 31-year-old hispanic male (non ICE) escaped from the booking area. He had been arrested for DUI and had spent several hours at the hospital and in isolation until he was sober enough to be booked. He was well known at the facility as he had been arrested on several previous occassions and had never been a problem. When the lone female Jailer removed him from a secure cell and brought him into the booking area, he bolted free from her b2High b2High As a result of this incident two changes were made; • b2High • Given the age and size of this facility, it appeared well maintained. Sanitation was good and detainee living areas were uncluttered. All of the staffwe dealt with were very cooperative and knowledgeable. * The facility states they have no way to reconstruct how many detainees were refered to the clinic over the last 12 months.
