LETTER OF CENSURE

Dear Trooper Salemo:
On December 5, 2014 you were operating your assigned Division vehicle when you
were involved in a troop car accident. This accident has been reviewed at Troop Headquarters and it
was determined to have been preventable on your part. On July 23, 2015 you appeared before me,
executed a waiver, and requested that I adjudicate the disciplinary action.
The accident occurred as you were responding, with emergency lights and siren
activated, to a rollover MVA on State Route 17M in the Village of Harriman. You slowed as you
approached a red traffic signal at the intersection with Harriman Heights Road and Church Street.
As you attempted to cross the intersection, you struck the passenger side of another vehicle. Your
Division vehicle was totaled. Although there were no injuries as a result of this accident, as a
professional driver, you are expected to drive more carefully.

It is my decision that you receive a letter of censure for your actions. Additionally, I
have determined that you will be scheduled for additional instruction with the Troop F Safety Officer
or Traffic Supervisor. I trust that you will drive more cautiously in the future.

AMSM2113S35BR, SP Monroe, dated December 5, 2014, and the attached Genl. 84
Investigation Report of Sergeant MARK A. PRESTIGIACOMO, SP Monroe, dated December
22, 2014, regarding the above-captioned matter.
A review of this two-car property damage accident revealed that on December 5,
2014, Trooper DANIEL J. SALERNO, was working a 1 shift and operating Division vehicle 2F4.
At approximately 3: 10pm, with lights and siren activated, Trooper SALERNO was responding to
a rollover MV A on State Route 17M in the Village of Harriman. Trooper SALERNO slowed 2F4
as he approached a red traffic signal at the intersection with Harriman Heights Road and Church
Street. As he attempted to cross the intersection, he struck passenger side of another vehicle (V2). 2F4 was totaled and no one was injured as result of the collision.
Investigation determined that although Trooper SALERNO was in emergency
operation with lights and siren activated, the culpability for this accident lies upon his actions.
Trooper SALERNO failed to enter the intersection with due care. It is recommended that this
property damage accident be classified as "preventable" on the part of Trooper SALERNO and
appropriate administrative action be taken.

Reference is made to Administrative Message# AMSM2113S35BR, SP Monroe,
dated 12/05/14, and the attached investigative report, subject captioned above, dated 12/22/14.
This investigation revealed that on December 5th , 2014 at approximately 3: I 0
p.m., Troi;:,per DANIEL J. SALERNO, SP Monroe EOD 11/26/12, was operating marked
Division Vehicle 2F4 and was responding to a rollover MVA, on State Route 17M in the Village
of Harriman. Trooper SALERNO was in emergency operation, with lights and sirens activated,
and was traveling westbound on State Route 17M approaching a red traffic signal at the
intersection of Harriman Heights Road/Church Street. Trooper SALERNO slowed 2F4 as he
approached the intersection and briefly entered the eastbound lane to pass around an uninvolved
vehicle stopped at the traffic light. Trooper SALERNO then r e - e n ~ e as he
entered into the intersection. V-2, a 2014 Ford Fusion operated b y - w a s
traveling northbound on Harriman Heights Road crossing over State Route) ·1M to Church Street
subsequently collided with 2F4. The investigation, including an account provided by an
independent witness, determined that V ~2 was traveling at a high rate of speed as it entered into
the intersection and failed to yield to 2F4 while in emergency operation.- It was also determined
that Trooper SALERNO was in emergency operation, with lights and siren activated, and that he
failed to slow down as necessary and take precautionary measures prior to proceeding into the
intersection. Although V-2 failed to yield to an emergency vehicle, it was Trooper SALERNO'S
responsibility to approach, enter, and cross the intersection prepared to avoid an accident that
might occur through the actions of other drivers.
I respectfully recommend that this investigation be classified as "Preventable," as
Trooper SALERNO, failed to enter the intersection with due care.

I was advised of my contractual right to representation pursuant to Article 16 of the
contract by Sergeant MARK A. PRESTIGIACOMO on December 05, 2014 and provide the
following written account.
On December 05, 2014 I was assigned to a scheduled 1 Shift out of SP Monroe and I was
driving Division vehicle 2F4. At approximately 3:10 PM I was responding to an Orange Cowity
911 poll for a rollover MV A on ST-l 7M in the Village of Harriman. I was operating 2F4 in
emergency operation, with the emergency lights and sirens activated, traveling westbound on ST17M, approaching a red traffic signal, at the intersection of Harriman Heights Rd/Church St. As I
approached the intersection, I slowed to approximately 20-25 mph and moved into the eastbound
lane of travel to avoid a vehicle that was stopped at the traffic light. I observed the intersection to
be clear and began to proceed through. At that point, a 2014 Ford Fusion bearing NY registration
- a v e l i n g northbound across ST-l 7M, crossing from Harriman Heights Rd. to Church
St., crossed directly in front ofme colliding with 2F4. As a result of the collision, I lost control of
2F4 and exited the roadway coming to rest in the shopping plaza parking lot at the northwest
comer ofST-17M and Church ST. I did not sustain any injuries as a result of the auto accident.
The driver of

1. On 12/05/14 at approximately 3:10 p.m., I was advised by SP Monroe desk that Trooper DANIEL J. SALERNO,
SP Monroe EOD 11/26/12, who was operating Division vehicle 2F4, was involved in a two car Property Damage
Accident on State Route 17M by the intersection of Harriman Heights Road and Church Street in the Village of
Harriman. No injuries were reported. Assistant Zone Commander, Lieutenant CHRISTOPHER T. ZABA was
advised. Sergeant MARK A PRESTIGIACOMO assigned to investigate.
2. On 12/05/14 at approximately 3:20 p.m., Sergeant/SC KENNETH A. WARD and I arrived on scene which is
described as follows: Marked Division vehicle z'F4 (V-1), a 2007 Chevrolet Tahoe, was in the middle of the of the
Harriman ~ - i m a n Post Office) parking lot nearest the east end facing in a northwesterly direction. NY
Passenger
(V-2), a 2014 Ford Fusion color gray, was facing in a southerly direction off the roadway in
landscaping on t e southeast corner of Harriman Plaza. The front of V-2 was partially on the southbound shoulder of
Church Street adjoining the landscaping. V-1 had sustained heavy front end damage along the front bumper, front
right and left quarter panels, and hood. The front and side curtain airbags had deployed in V-1. V-2 sustained heavy
damage along the front and rear passenger side door, as well as damage to the front and rear passenger side
quarter panels. The passenger side curtain airbags deployed in V-2.
3. The roadway, markings, and points of interest are described as follows: The collision occurred on State Route
17M at a four way intersection with Harriman Heights Road and Church Street. State Route 17M is a two lane road
running in a westerly and easterly direction with a no passing double yellow solid marking and a marked shoulder.
Harriman Heights Road runs in a northerly and southerly direction and is south of State Route 17M. Church Street is
directly across from Harriman Heights Road on the north side of State Route 17M and also runs in a northerly and
southerly direction. Both roadways also consist of a no passing double yellow solid marking and a marked shoulder.
In the middle of the intersection is a set of traffic signals controlling movement on State Route 17M, as well as both
Harriman Heights Road and Church Street. On the northwest corner of the intersection is Harriman Plaza which
consists of the Harriman Post Office, and K&G Wines and Liquors, and other vacant businesses. On the northeast
corner of the intersection is The Berkshire Bank. On the southeast comer is Cars Autobody and on the southwest
corner is a Citgo Gas Station (A&B Auto). There was a small amount of debris near the point of impact found in the
middle of the westbound lane of State Route 17M near Church Street. The roadway was dry and the weather was
cloudy with no precipitation. No skid marks were located.
4. On 12/05/14, I visually inspected V-1. V-1 was not video equipped. There appeared to be no visible damage to
the vehicle's radar, radio equipment, or Tracs computer; however, the battery cables had been cut and I was unable
to confirm weather said equipment was actually in working order. The shotgun assigned to V-1 was removed and
inspected and found to be undamaged. It was secured in the SP Monroe gun locker pending the vehicle repair.
5. On 12/05/14, I interviewed Trooper DANIEL J. SALERNO, operator of V-1 , who .stated that at approximately 3:10
p.m. was responding to a rollover motor vehicle accident on State Route 17M in the Village of Harriman dispatched
by Orange County 911 (SJS#6002390). Trooper SALERNO stated that he was in emergency operation with
emergency lights and sirens activated. Trooper SALERNO stated that he was traveling westbound on State Route
17M approaching a red traffic signal at the intersection of Harriman Heights Road/Church Street Trooper SALERNO
stated that he slowed to what he estimated to be 20-25 mph and entered the eastbound lane to move around a
vehicle stopped ahead at the traffic light in the westbound lane. Trooper SALERNO stated that he believed the
intersection was clear and re-entered the westbound lane and began to proceed through at which time V-2 entered
the intersection northbound from Harriman Height Road colliding with 2F4. As a result of the collision, Trooper

SALERNO stated that he lost control of V-1 , exited the roadway over curbing and landscaping on the northwest
comer of State Route 17M and Church Street, and had come to rest in the parking lot of Harriman Plaza. Trooper
SALERNO stated that he did not sustain any injuries in the collision and declined any medical attention. Trooper
SALERNO was directed to provide a Genl-7 Memorandum regarding the incident which is included as ENCLOSURE
#1 in this report.
6. On 12/05/14, I interviewe

northbound on Harriman Heights Road approaching the intersection with State Route 17M. --stated that he
had a steady green light as he approached the intersection. -stated that he heard sirens as he neared the
intersection and then observed two police vehicles go through the intersection. -assumed those were the
vehicles that the sirens were coming from and believed the intersection was clear to proceed through. ~ t a t e d
that he continued t ~ h e intersection crossing over to Church Street at which time he observed~of the
comer of his eye. -stated that he did not hav~h time to react subsequently colliding with V-1 in the
intersect!

7. On 12/05/14, Sergeant/SC WARD interviewed witness,
who stated that he was

8. On 12/05/14, I photographed V-1, V-2, and the scene as described above. A Genl-34D Digital Photo Record with
26 associated images are included as ENCLOSURE #5 in this report.
9. On 12/05/14, I completed a M~Police Accident Report/MV-104L Police Line of Duty Accident with assigned
report number SP2F123S2VZR. - w a s subsequently provided with an accident information exchange form. A
(;:Opy of the MV-104A/MV-104L is included as ENCLOSURE#6 in this report
10. On 12/05/14, V-1 was towed by Luke's Towing to SP Monroe. V-2 was towed by and to Loyal Towing.
11 . On 12/05/14, Administrative Message Report AMSM2113S35BR was sent from SP Monroe reporting Division
Vehicle, two car, Property Damage Accident and was sent to Division Headquarters. This report is included as
ENCLOSURE #7 in this report.
12. On 12/10/14, I canvassed the area of the accident scene for any local businesses with surveillance footage of
the collision. Th.e following businesses were checked with negative results: Citgo Gas Station (A&B Auto),
Enterprise Rent-A-Car, Harriman Post Office, K&G Wine and Liquor, The Berkshire Bank, Marina Restaurant, and
Gold's Gym. I spoke with an employee at Cars Auto Body who stated that his employer would possibly have
surveillance footage from a camera which points in the direction of the intersection and that he would advise him to
contact me.

13. On 12/21/14, I met with GREGORY S. EPSARO-owner of Cars Autobody, located at 85 State Route 17M
in the Village of Harriman (845)782-2505. EPSARO assisted me in reviewing his video surveillance footage from his
business. One of the cameras pointed in the direction of the intersection of State Route 17M and Harriman Heights
Road/Church Street. The surveillance system was about 15 years old and very poor quality; however, we were able
to view the collision. The video showed V-1 traveling westbound on State Route 17M in the eastbound lane around a
vehicle stopped at the traffic light in the westbound lane. V-1 then re-entered the westbound lane subsequently
colliding with V-2 in the intersection closest to Church Street. It could also be seen that V-1 had emergency lights
activated. The video also showed a passenger vehicle which appeared to be a Mini Cooper traveling eastbound on

State Route 17M pulled onto the shoulder allowing V-1 to pass through. The Mini Cooper had made a right hand turn
onto State Route 17M from Harriman Heights Road. V-2 could be observed traveling from Harriman Heights Road
and crossing over State Route 17M to Church Street in front of the path of V-1. Approximately 30 seconds prior to
the collision a fire truck could be seen pulling onto State Route 17M westbound from Church Street with emergency
lights activated. There were no ~ c e vehicles observed passing through the intersection on the video around
the lime of collision as stated b ~ The video only showed a partial view of the intersection, with poor quality,
and skipping. I was unable to estimate the speeds of V-1 and V-2 as they entered the intersection. The video also
did not show the traffic signal, but it appeared from the movement of the vehicles at the intersection that Trooper
SALERNO did have a red traffic signal upon his approach and had not stopped before entering the intersection. The
video did not have audio, so I was unable to substantiate if Trooper SALERNO had the siren activated. EPSARO
stated that due to being an antiquated system he was unable to burn a copy of the video to a disc or send it through
an e-mail. EPSARO attempted to contact the company that installed the system with negative results. EPSARO
stated that the video footage is retained in the system for approximately three months before being purged.
14. On 12/22/14, I received a copy of the estimate for repairs from Troop F AMI. A copy of this estimate is included
in this report as ENCLOSURE #8.
15. On 12/22/14, I included copies of SJS# 6002485 and SJS# 6002390 as ENCLOSURES #9 and #10 respectively
in this report.

Around 3:10 PM today the 5th of December, I was driving home from work in Harriman. I live in

down Harriman Heights Road approaching Route 17M. J had a steady green light as I came down the hill approaching 17M. I
heard sirens as I was getting closer to 17M and then saw two police cars go through the intersection of 17M and Harriman
Heights Road with their lights on. They were far away as / approached the intersection, so I didn't even need to slow down or
yield to them. I figured those were the only vehicles that had sirens on and they had already cleared the intersection, so I
continued through the intersection to cross over to Church Street. That's when I got hit by the Troop car. I didn't even see him
until last second out of the comer of my eye, but by that time it was too late to stop. He was going around another car that was
stopped in the intersection. I believe he had his lights on, but like I said it was too late for me to even react. I was not injured.
J was checked out by the EMT's and refused any further medicaf attention.

On 12/05/14 at approximately 3:10 p.m_, Trooper DANIELJ. SALERNO (EOD 11/26/12), working a scheduled 1 shift out of
SP Monroe, was responding in Division vehicle 2F4 to a rollover MVA on ST -17M in the V/Harriman. Trooper SALERNO was
westbound on ST-17M approaching a red traffic signal at the intersection of Harriman Heights Rd./Church St with emergency
lights and sirens activated. Trooper SALERNO slowed to approximate! 20 to 25 m · h as he entered the intersection. V-2, a
2014 Ford Fusion bearing NY registration-operated b
was traveling northbound across ST-17M
crossing from Harriman Heights Rd. over to Church St
ailed to yield the right of way to 2F4 subsequently colliding
with 2F4_ 2F4 and V-2 both exited the roadway coming to rest in a shopping plaza parking lot at the northwest comer of
ST-17M and Church St. No injuries reported by either party. - w a s evaluated by T/Monroe Ambulance and refused any
