SYNOPSIS:
On August 14, 2018 at approximately 5:58 a.m., Trooper JAMES L. DJSTASI, SP
Highland, was operating marked Division vehicle 3F28, a 2015 Ford Police Interceptor, enroute to a MidHudson Bridge detail. Trooper DISTASl was operating southbound on North Road in the Town of
Lloyd, a p p r o x i m ~ t h e intersection with State Route 9W, when 3F28 subsequently
struck pedestrianlllllllllllllllith the front driver side of 3F28. After thorough investigation
and review of the incident, it is concluded the cause of this incident is pedestrian error and that no NYSP
rules or regulations were violated by Trooper DISTASL I recommend this matter be classified as closed
by investigation
DETAILS:
1.
On August 14, 2018, infonnation was received at PSB-SRO that a Division vehicle had a struck a
pedestrian on North Road in the Town of Lloyd. Staff Inspector ROBERT C. GREGORY and Captain
LAWRENCE A. MULLER responded to the scene and obtained preliminary infonnation that Trooper
JAMES L. DISTASI was operating marked unit 3F28 southbound on North Road and struck pedestrian

AT NORTH ROAD, TROOP F, LLOYD, NEW YORK

As part of the Division Vehicle PIAA investigation conducted by Lieutenant MICHAEL W.
SUMNICK, SP Kingston, Sergeant Station Commander JAMES P. FITZMAURICE, SP Catskill,
submitted a Memorandum detailing his involvement in the incident. In sum and substance, Sergeant SIC
FJTZMAURJCE stated that on August 14, 2018, at approximately 6:20 a.m., he was contacted by
Sergeant HEATHER M. SAVAGE, SP Kingston who advised him of a Troop car vs. pedestrian accident
in the town of Lloyd. Sergeant SIC FITZMAURICE further stated he responded to the scene and
interviewed Trooper JAMES L. DISTASI, SP Highland, who advised that he was operating unit 3F28,
enroute to a Mid-Hudson Bridge detail. Further, Trooper DISTASI stated that shortly prior to 6:00 a.m.,
he made a right tum off of State Route 9W and was traveling south on North Road. Trooper DISTASI
stated that after turning onto North Road, he was traveling at approximately 35 MPH and struck a
pedestrian, who was walking in the center of the roadway. Trooper DISTASI stated that due to the
darkness, he was unable to tell which direction the subject was walking. Trooper DIST AS[ further stated
that the pedestrian was injured, conscious, and transported to Mid-Hudson Regional Hospital prior to the
arrival of Sergeant S/C FITZMAURICE. A copy of the Memorandum submitted by Sergeant SIC
FITZMAURICE is attached to this report as Enclosure #1.
AT SP KINGSTON, TROOP F, KINGSTON, NEW YORK

As part of the Division Vehicle PIAA investigation conducted by Lieutenant MICHAEL W.
SUMNICK, Sergeant HEATHER M. SAVAGE, SP KINGSTON, submitted a Memorandum detailing her
involvement in the incident. Sergeant SAVAGE stated in sum and substance that on August 14, 2018, at
approximately 6:20 a.m., she was in Division vehicle 3F55 and was contacted by Troop F
Communications via radio. Subsequently, Sergeant SAVAGE called SP Kingston and spoke to Trooper
JOSEPH T. COLBY, SP Kingston, who advised her that a Trooper from SP Highland had been in an
accident. Further, Trooper COLBY advised that he believed Trooper DISTASI had struck a pedestrian

ancl that he had no further information at that time. Sergeant SAVAGE further stated she contacted
Trc,oper DISTASI, who stated that he had struck a pedestrian on North Road, that the subject appeared to
have an injury to his arm and that he contacted EMS. Sergeant SAVAGE further stated she contacted
Sergeant SIC JAMES P. FITZMAURICE, who advised that he would respond to the scene. A copy of the
Memorandum submitted by Sergeant SAVAGE is attached to this report as Enclosure #2.
AT SP KINGSTON, TROOP F, KINGSTON, NEW YORK
4.
As part of the Division Vehicle PIAA investigation conducted by Lieutenant MICHAEL W.
SUMNICK, Trooper JOSEPH T. COLBY, SP Kingston, submitted a Memorandum detailing his
involvement in the incident. Trooper COLBY stated that on August 14, 20 L8 at approximately 6:00 a.m.,
he was in the station patrol room when he received a phone call from Trooper D[STASl asking to speak
to a supervisor regarding an incident that he was involved in. Trooper COLBY further stated he advised
Trooper DISTASI that the Sergeant was Sergeant SAVAGE, but that she had left the station and was
enroute to SP Coxsackie. Trooper COLBY further stated he had Trooper DISTASJ explain the situation
to him, so that he (Trooper COLBY) could relay the information to Sergeant SAVAGE. Trooper
COLBY stated Trooper DIST ASI infom1ed him that his Troop car struck a pedestrian on North Road in
the Town of Lloyd and that he was enroute to the bridge detail at the Mid-Hudson Bridge. Trooper
DJSTASI further advised that the pedestrian was conscious and alert, but appeared to be injured and was
being transported to Mid-Hudson Regional Hospital. Trooper COLBY further stated he then contacted
Sergeant SAVAGE and advised her what Trooper DlSTASI stated. A copy of the Memorandum
submitted by Trooper COLBY is attached to this report as Enclosure #3.

As part of the Division Vehicle PIAA investigation conducted bY' Lieutenant MICHAEL W.
SUMNICK, Trooper JAMES L. DISTASI, SP Highland, submitted a Memorandum detailing his
involvement in the incident. Trooper DISTASI stated in sum and substance that on August 14, 2018, he
wa:; working a 1-8 shift and the morning Mid-Hudson Bridge detail out of SP highland, assigned to
Division vehicle 3F28. Trooper DISTASI further stated that at approximately 5:58 a.m., he was traveling
sou.th on North Road in the Town of Lloyd, approximately 1,000 feet south of State Route 9W. Trooper
DH,TASI stated that the road conditions were wet and the roadway was foggy and unlit. Trooper
DISTAS I further stated that a dark object suddenly appeared in the middle of the roadway near the driver
sid ! of 3F28 and he was unable to apply the brakes, subsequently striking the object with the driver side
front portion of 3F28. Trooper DIST AS I stopped and got out of his vehicle and saw a male laying on the
shculder of North Road. Trooper DISTASI went to the male subject and observed that he was conscious
anc,. responsive. Trooper DISTASI advise-ounty 9 11 of the accident and requested Fire and
EMS. Trooper DISTASI stated he advised
not to move, in attempt to keep him stabilized until
EMS arrived. Trooper DISTASI stated he contacte SP Kingston and advised Trooper COLBY that he
needed a Sergeant. Highland Fire Department arrived on scene and took over patient care. Trooper
DI~,T ASI stated that he was then contacted by Sergeant SAVAGE and he advised her what happened. A

AT ULSTER COUNTY 911 CENTER, ULSTER COUNTY, NEW YORK

On August 14, 20 I 8, Trooper DISTASJ contacted Ulster County 9 l l just after his vehicle struck
the pedestrian and requested Fire and EMS. A copy of the subsequent phone conversation and radio
transmissions were secured on a disk, a copy of which is anached to this report as Enclosure #5.

On August 14, 2018, Sergeant Station Commander THOMAS J. FARREL, SP Highland,
responded to Mid-Hudson Regional Hospital. Sergeant S/C FARREL learned that the individual struck

Sergeant SIC FARREL was unable to interview - a b o u t the accident due to his medical
condition. S ~ FARREL interviewed Emergency Room Charge Nurse, TAMARA IGOE, who
advised that llllllllllllllad serious injuries and was listed in critical condition. Sergeant S/C FARREL
obtained a completed Medical Services Deposition from IGOE and a copy is attached to this report as
Enclosure #6. A copy of the GENL-34O and disk containing the photos taken by Sergeant S/C FARREL
is attached to this report as Enclosure #7.

On August 14, 2018, Sergeant Station Commander JOHN J. FISHER, SP Kingston, responded to
the accident scene and photographed the scene. A GENL-34D was generated and the photos were
recorded on a disk. A Copy of the GENL-34D and disk containing the photos is attached this report as
Enclosure #8.

On August 14, 2018, Trooper THOMAS G. BRENNAN, SP highland, Troop F CRU, responded
and photographed the scene. A GENL-34D was generated and the photos were recorded on a disk. A

On August 14, 2018, Trooper KYLE M. MARKLE, SP Montgomery, Troop F CRU, responded
and utilized Unmanned Aircraft Systems (UAS) to photograph the scene. A GENL-34O was generated
and the photos were recorded on a disk. A Copy of the GENL-34D and disk containing the photos is
attached this report as Enclosure# 10.

On August 14, 2018, Senior Investigator WILLIAM E. FITZMAURICE, SP Catskill, completed
and sent Administrative Message Report (AMS) #AMSP1618KVl6C. A copy of the AMS report is

AT PREMIER AUTO BODY, 181 NORTH ROAD, TROOP F, LLOYD, NEW YORK

On August 14, 2018, Investi utor MICHAEL A. CORLETTA SP Middletown interviewed
RICAHRD L. SIMPSON, DOB:
regarding the incident.
SIMPSON stated he has worked at rem1er uto o y, ocat at

oad, for approximately 3
years and generally arrives to work around 5:30 a.m. or 5:45 a.m., Monday through Friday. SIMPSON
further stated that every so often, he sees a white male walking on North Road when he is coming to
work, and that he (SIMPSON) is driving north on North Road when he sees the male walking. Simpson
provided a description of the male he sees walking as having dark hair, unsure about facial hair,
approximately 5 feet, 6 inches tall and about 175 pounds. SIMPSON further stated the male walks about

3 to 4 feet from the shoulder of the road with his back towards traffic. SIMPSON further stated he
believes the male is on the wrong side of the road when he is walking. SIMPSON stated he has almost
struck the individual a couple of times when driving. A GENL-4 Supporting Deposition was secured
from SIMPSON and a copy is attached to this report as Enclosure #12.

13.
On August 14, 20 I8, Sergeant SIC FISHER interviewed Town of Lloyd Police Officer, JESSE
VAIL, 25 Milton Ave, Highland, NY. Officer VAIL stated he arrived on scene shortly after the accident
occurred and provided little information to assist wid2Jb£..iLlvesti ation. Officer VAIL further stated he
was able to ascertain that the pedestrian's name was - a n d

AT SP KINGSTON, TROOP F, KINGSTON, NEW YORK
14.
On August 14, 2018, Sergeant SIC FISHER completed MV-104A Police Accident Report
#SPP 1628LHPLK, which was subsequently approved through channels at Troop F Traffic. The findings
of the investigation pertaining to this Police Accident Report document the cause of the accident as
pedestrian error. A copy of the Police Accident Report is attached to this report as Enclosure # 14.

On August 16, 2018, Investigator JAN C. ANTHONY, Troop F FIU, photographed the scene of
the accident to document the light conditions and roadway conditions. A GENL-34D was generated and
the photos were recorded on a disk. A Copy of the GENL-34D and disk containing the photos is attached
this repott as Enclosure #15.
AT PSB-SRO, TROOP H, HOPEWELL JUNCTION, NEW YORK

was advised by NPPD
regarding the numerous complaints that have been made regarding his low visibility while walking on the
road. The MV-104A Police Accident Report is documented in investigative paragraph 20. A copy of the
NPPD call for service report regarding this incident is attached to this report as Enclosure# 19.

On August 16, 2018, I re--iewedaperwork obtained from the Town of New Paltz Police
Department (NPPD) that involved

dark colored clothes. MV-104A Police Accident Re ort - - - - c o m p l e t e d by NPPD
documented a collision in which a vehicle struck
as a pedestrian. The MV-104A documented
~ e h i c l e was northbound and
was also northbound walking with ~ r t h e r ,
- w a s on the unlit road waring all black clothing and the light level was dark. - s t a t e d
that he was struck from b e - l e f t shoulder but was uninjured. The apparent contributing factor
for this report was listed as
ommitting "pedestrian/bicyclist/other pedestrian error/confusion".

AT SP KINGTON, TROOP F, KINGSTON, NEW YORK
21.
As part of the Division Vehicle PIAA investigation conducted by Lieutenant MICHAEL W.
SUMNICK, a damage estimate for 3F28 was obtained from Troy's Auto Body. Troy's Auto Body
submitted a damage estimate dated September 24, 2018 at a value of $6,56 1.06 to repair 3F28. A copy of
the estimate is attached to this report as Enclosure #21.

As part of the Division Vehicle PIAA investigation conducted by Lieutenant MICHAEL W.
SUMNICK, on September 26, 2018, Trooper MARKLE, who was assigned to reconstruct the
circumstances of collision, submitted a preliminary findings Memorandum. Trooper MARKLE
determined the primary cause of the accident to be pedestrian error. Trooper MARKLE indicated that the
pedestrian was walking in the middle of the road when the accident occurred. A copy of the preliminary
findings Memorandum submitted by Trooper MARKLE is attached to this report as Enclosure #22.

On October 29, 2018, Lieutenant SUMNICK completed a Division Vehicle PIAA report
documenting the incident. It was noted that at the t i m e ~ r t , that WILSON was currently in the
hospital and several attempts by Members to interview~nd obtain medical records have both
been met by negative results.
Lieutenant SUMNNICK agreed with the preliminary findings
Memorandum of Trooper MARKLE, that the cause of the accident was pedestrian error on the part of

AT PSB.NRO, TROOP H, ALBANY, NEW YORK
24.
On November 7, 2018, I confe1Ted with Senior Investigator MICHAEL J. KIJOWSKI, NYSP
Business Integration Unit, regarding the Automatic Vehicle Locator Records on Division Vehicle 3F28
relating to the date and time of the incident. Senior Investigator KUOWSKI provided a printout of the
speeds and associated times with 3F28 in the time proximity of the incident. Said printout shows vehicle
3F28 was recorded by the A VL as traveling at the following speeds: 26 MPH at 6:00:34 a.m., 46 MPH at
6:01 :02 a.m., 40 MPH at 6:01 :26 a.m. and O MPH at 6:03: 18 a.m. as well as O MPH for next several
hours after 6:03 : 18 a.m. It was ascertained that the collision occurred sometime between the AVL
recorded time of 6:0 I :26 a.m. and 6:03 . 18 a.m. It was noted that the speed limit on North Road where the
inc ident occurred is 30 MPH and Trooper DISTASI indicated to Sergeant SIC FITZMAURICE that his

speed was approximately 35 MPH before the collision, which is consistent with the AVL records. A copy
of the AVL printout is attached to this report as Enclosure #24.

The completed Collision Reconstruction report completed by Trooper MARKLE was published
on 3/5/19. The report thoroughly documents the Collision reconstruction and the events of the collision
are consistent with the reports given by Trooper DIST ASJ. Further, the report documents the roadway
was checked for any defects or items that may have contributed to the collision, with no such defects or
items being observed. The report also documents
wearing dark colored clothing, with no
clothing having reflective properties and the possibility of
being seen walking in the middle of
the road was further hindered by the lack of artificial light as well as the weather conditions at the time of
the incident. The report states the primary contributing factor for this collision as it relates
of all subject matter surrounding the investigation was pedestrian error on the (!art of
walking in the roadway. Further, Additional consideration should be given to
lac
reflective clothing, the lack of artificial ambient lighting in the area, as well as t e a verse weather
conditions present at the time of collision. All of which would have had an adverse effect on the view out
the front windshield that the operator would have experienced prior to the collision. A copy of the
Collison Reconstruction Report is attached to this report as Enclosure #25.
SP Highland adopted the case as a car/pedestrian PJAA. The case is documented under SJS
8417412 and is i n v e ~ Senior Investigator FITZMAURICE, SP Catskill. As of 3/5/2018,

attempts to interview11111111111111ave been met with negative results. The BCI case remains pending and
will be submitted under a separate cover.
CONCLUSION
After d1orough review of all circumstances surrounding the incident, I agree with the findings of
the Police Accident Report completed by Sergeant SIC FISHER and the Collison Reconstruction Report
completed by Trooper MARKLE. At the time of collision,~as wearing dark colored clothing
and walking in the middle of North Road. Trooper DISTASI was operating southbound on North Road,
which is an unlit roadway with no lane markings on the pavement. At the time of collision, the pavement
was wet due to rain and there were foggy and cloudy conditions. Despite Trooper DISTASI seeing an
object suddenly appear in front of him, there was no way for Trooper DIST AST to be able to react and
take any type of evasive action prior to the collision. Due to the aforementioned circumstances, Trooper
DISTASl was unable to avoid a collision w i t h - v h o was walking illegally in the roadway,
walking south in the southbound lane. There is no evidence that Trooper DISTASI contributed to this
collision or that he violated any NYSP rules or regulations. I recommend this matter be closed by
investigation with no further action taken.

On August 14, 2018, I was working a 5B tour out of SP Catskill. At
approximately 6:20 am, I received a phone call from Sergeant HEATHER SAVAGE, SP
Kingston. Sergeant SAVAGE stated she had received a report of a Troop Car/Pedestrian
in the Town of Lloyd, Ulster County. I advised Sergeant SAVAGE I would respond and
notified Lieutenant MICHAEL W. SUMNICK.
I arrived at the scene and observed that the pavement was wet from recent
rain, with low light conditions due to overcast sky, time of day and the canopy overhang in
the area of the accident. I interviewed Trooper JAMES L. DISTASI, SP Highland, who
stated he was en route in Division vehicle 3F28 to Mid-Hudson Bridge Detail overtime.
Trooper DISTASI stated just prior to 6:00 am he made a ri ht turn off of State Route 9W
and was traveling south on North Road,
Shortly after turning onto North Road, Trooper DISTASI stated he was
~ o x i m a t e l y 35 M.P.H. and subsequently struck a pedestrian, who was walking
in the center of the roadway. Trooper DISTASI stated due to the darkness of the roadway,
he was unable to tell what direction the subject was walking. Trooper DISTASI informed
me that the pedestrian was injured and conscious, but he was unsure the extent to the
injuries. Trooper DISTASI advised me that the pedestrian was already transported by
ambulance to Mid-Hudson Regional Hospital in Poughkeepsie, NY. Lieutenant SUMNICK
arrived on the scene and I informed him what Trooper DISTASI had told me.

me that he was in 3F28 and he was en route to the bridge detail at the Mid-Hudson bridge.

I was advised of my rights to representation pursuant to Article 16.2 of the contract by
SERGEANT/STATION COMMANDER THOMAS FARRELL on September 3, 2018 and
submit the following account.
On Tuesday August 14, 2018, I was working a 1-8 shift and the AM Mid-Hudson Bridge
Detail out of SP Highland assigned to 3F28. At or about 5:58 AM, I was traveling southbound
on North Road in the Town of Lloyd approximately 1000 feet south of State Route 9W. The
road conditions were wet and the roadway was foggy and unlit. While southbound, suddenly a
dark object appeared in the middle of the roadway near ~e driver side front of the troop car. I
was unable to apply the brakes and subsequently struck the object with the driver side front
portion of the troop car. I saw and heard the impact and the object disappeared from my view. I
stopped the troop car and observed a male laying face up in the northbound shoulder of North
Road. I went to the subject who was conscious and responsive. I then notified Ulster County
911 of a car/pedestrian accident that had occurred at the location and requested Fire and EMS. I
then assisted the patient by advising him to not move in attempt to keep him stabilized until EMS
arrived. I contacted SP Kingston and spoke to TROOPER JOSEPH COLBY advising him I
needed to speak with a SERGEANT. Highland Fire Department arrived on scene and took over
patient care. SERGEANT HEATHER M. SAVAGE then contacted me and I briefed her of the
incident. Shortly thereafter EMS arrived on scene. I remained on scene until a roximatel 9:30
AM when I was trans orted to

PRELIMINARY FINDINGS- RECONSTRUCTION OF DIVISION
VEWCLE (3F28) PEDESTRIAN PERSONAL INJURY COLLISION
This memorandum is preliminary to the Collision Reconstruction Findings Report
that will follow Wlder a separate cover.
On August 14, 2018 I was assigned to reconstruct the circumstances of a car pedestrian personal injury collision involving a marked Division of State Police vehicle. The
collision occurred on August 14, 2018 at approximately 5:58 A.M. on North Road in the Town of
Lloyd, Ulster County, New York.
North Road in the area of the collision was an unlighted, two way, two lane, not
physically divided roadway that proceeds in a general north/south direction, with one lane designated
for northbound travel and one lane designated for southbound travel. There is no roadway lines
separating the northbound and southbound lanes of travel.
I arrived on scene at approximately 9:45 A.M. and met with members on the scene. I
observed Vehicle #1 a 2015 Ford Taurus, marked State Police unit 3F28 stopped in the geographic
center of the southboW1d lane of travel of North Road.
The investigation indicated that Trooper JAMES L. D I S - - # 1 ,

then re~directed onto the grassy/dirt area adjacent to the northbound lane of
travel.
The area ofimpact was located near the geographic center ofNorth Road. There was
a scuffmark observed on the pavement, along with an array of glass and vehicle debris that extended
in a southeasterly direction from the area of impact on North Road.
The preliminary findings indicated the primary contributing factor in this collision is
error on the part of the pedestrian for walking in the middle of the roadway.
The Collision Reconstruction Findings Report, a memorandum outlining causative
and contributing factors and a complete analysis of the available evidence and information will
follow under separate cover.

I. On August 14, 2018, at approximately 5 :58 AM, Trooper JAMES L. DISTASI, shield 530, SP
Highland, was operating (V-1) marked Division vehicle 3F28, a 2015 Ford Police Interceptor, en route
to Mid-Hudson Bridge detail. 3F28 was traveling south on North Road in the Town of Lloyd,
approximately 1000 feet south of the State Route 9W intersection, when 3F28 subsequently struck a
pedestrian with the front driver side of 3F28. Trooper DISTASI contacted Ulster County 911 and
advised them of a car/pedestrian accident at that location. Trooper DISTASI requested a supervisor to
the scene and Sergeant Station Commander JAMES P. FITZMAURICE responded.
2. Sergeant Station Commander FITZMAURICE contacted Lieutenant MICHAEL W. SUMNICK and
advised that Trooper DISTASI was involved in a Troop car/pedestrian accident on North Road in the
Town of Lloyd. Sergeant Station Commander FITZMAURICE further advised that the pedestrian was
transported to Mid-Hudson Regional Hospital in Poughkeepsie, NY and the extent of the injuries were
unknown. Lieutenant SUMNICK advised Captain MICHAEL J. DRAKE and both Lieutenant
SUMNICK and Captain DRAKE responded to the scene of the accident.
3. Sergeant Station Commander JOHN J. FISHER responded to the accid~nt scene and photographed the

9. On August 16, 2018, Troop F FIU Investigator JAN ANTHONY photographed the scene of the accident
to document the light conditions and roadway conditions. A Genl. 34d, Digital Photo Record, a disc
containing photos and photos can be found attached as Enclosure #7.
10. Trooper DISTASI provided a memorandum pertaining to the accident. Trooper DISTASI stated that on
August 14, 2018, he was working a 1-8 shift and the momjng Mid-Hudson Bridge detail out of SP
Highland assigned to 3F28. At approximately 5:58 AM, he was traveling south on North Road in the
Town of Lloyd, approximately 1000 feet south of State Route 9W. Trooper DISTAST stated that the
road conditions were wet and the roadway was foggy and unlit. Trooper DISTASI stated that a dark
object appeared in the middle of the roadway near the driver side of3F28 and the vehicle subsequently
struck the object. Trooper DISTASI stopped 3F28, got out of the vehicle and saw a male laying in the
northbound shoulder of North Road. Trooper DISTASI went to the male subject and observed that he
was conscious and responsive. Trooper DISTAS I stated that he advised Ulster County 911 of the
accident and requested fire and EMS. Trooper DISTASI advised-not to move, in an attempt
to keep him stabilized until EMS arrived. Trooper DISTASI contacted SP Kingston and advised
Trooper JOSEPH COLBY that he needed a Sergeant. Highland Fire Department arrived on scene and
took over patient care. Trooper DISTASI stated that he was then contacted by Sergeant HEATHER M.
SAVAGE and he informed her what happened. A copy of Trooper DISTASI'S memorandum can be
found attached as Enclosure #8.
11 . Sergeant Station Commander FITZMAURICE submitted a memorandum regarding his involvement in
this incident. Sergeant Station Commander FITZMAURICE stated that on August 14, 2018, he was
working a SB tour out of SP Catskill and was contacted by Sergeant SAVAGE at approximately 6:20
AM. Sergeant Station Commander FITZMAURICE stated that she advised him of a Troop
Car/pedestrian accident in the Town of Lloyd and he then responded to the scene. Sergeant Station
Commander FITZMAURICE arrived and interviewed Trooper DISTASl, who advised that he was en
route to Mid-Hudson Bridge Detail in 3F28 just prior to 6:00 AM. Sergeant Station Commander
FITZMAURICE stated that Trooper DISTASI was traveling south on North Road and subsequently
struck a pedestrian, who was walking in the roadway. Trooper DISTASI informed Sergeant Station
Commander FITZMAURICE that he was unable·to tell what direction the pedestrian was walking due to
darkness. Trooper DISTASI ftu1her advised Sergeant Station Commander FITZMAURICE that the
pedestrian was injured and conscious, but didn'.t know the extent of the iitjuries. Trooper DISTAS I
informed Sergeant Station Commander FITZMAURICE that the pedestrian was taken to Mid-Hudson
Regional Hospital in Poughkeepsie, NY. Sergeant Station Commander FITZMAURICE advised
Lieutenant SUMNICK what Trooper DISTASI stated upon Lieutenant SUMNICK'S arrival. A copy of

12. Troy's Auto body completed an estimate for the damage to 3F28 and indicated that it will cost
$6,561.06 to repair 3F28. A copy of the estimate can be found attached as Enclosure #JO.
13. Sergeant SAVAGE was interviewed regarding this accident and stated in sum and substance that on
August 14, 2018, at approximately 6:20 AM, she spoke with Trooper COLBY at SP Kingston, who
advised that Trooper DISTASI, SP Highland was involved in an accident. Sergeant SAVAGE contacted
Trooper DISTASI, who advised that he had struck a pedestrian on North Road near State Route 9W in
the Town of Lloyd. Sergeant SAVAGE stated that Trooper DISTASI informed her that the pedestrian
appeared to have an arm inj,ury and EMS was contacted. Sergeant SAVAGE then spoke with Sergeant
Station ~ommander FITZMAURICE, who advised he would respond to the scene. A copy of SergeatJt
SAVAGE'S memorandum can be found attached as Enclosure #11.
14. Trooper COLBY was interviewed and stated in sum and substance that on August 14, 2018, he was
working a 2 shift out of SP Kingston. Trooper COLBY stated that at approximately 6:00 AM, he
received a phone call at SP Kingston from Trooper DISTASL Trooper D1STASI informed Trooper
COLBY that he had just been involved in a Troop car/pedestrian accident on North Road in the Town of
Lloyd and be needed to speak to a Sergeant. Trooper DISTASI advised that he was in 3F28 and en
route to the Mid-Hudson Bridge detail. Trooper DISTASI advised that the pedestrian was conscious and
alert, but was injured and being transported to Mid-Hudson Regional Hospital in Poughkeepsie, NY.
Trooper COLBY then contacted Sergeant SAVAGE and advised her. The phone conversation took
place on a non-recorded phone line at SP Kingston. A copy of Trooper COLBY'S memorandum can be
found attached as Enclosure #12.
15. Trooper DISTASI called Ulster County 911 just after his vehicle struck the pedestrian and he requested
fire and ems. A copy of this phone conversation and subsequent radio transmissions were secured on a
disc and can be found attached as Enclosure #13.
16. Sergeant Station Commander FISHER completed an MV-104A, Police Accident Report
(SPP I 628LHPLK). I discussed the findings of this report with Sergeant Station Commander FISHER
and agree with his findings, that being the cause of the accident is due to pedestrian error. A copy of
thi~ MV-104~ can be found attached as Enclosure #14.
17. I conferred with Senior Investigator LANGOWSKY, Investigator BRIAN HUNTER and Trooper
MARKLE regarding this accident. Trooper MARKLE was assigned to reconstruct the circumstances of
this accident. On September 26, 2018, Trooper MARKLE completed a Preliminary Findings
memorandum and has determined the primary cause of this accident is pedestrian error. Trooper
MARKLE had indicated that the pedestrian was walking in the middle of the road when the accident
occurred. A copy of the Preliminary Findings memorandum can be found attached as Enclosure # 1S.
18. I spoke with Senior Investigator FITZMAURICE, who advised that the SP Highland BCI Investigative
Report is currently open and a completed Investigative Report will be submitted at a later date under

19. After conferring with Troop F CRU, reviewing photos and documents, I agree with the Preliminary
Findings memorandum that was completed by Trooper MARKLE. On August 14, 2018 at the time of
the accident, the pedestrian WILSON was wearing dark colored clothing and walking in the middle of
North Road. Trooper DISTASI was operating 3F28 southbound in the south lane of North Road, which
is an unlit roadway with no lane markings on the pavement. At the time of the accident, the pavement
was wet due to rain and there were foggy and cloudy conditions. Trooper DISTASI saw an object
appear at the driver side front of3F28 and subsequently struck the object. Trooper DISTASJ was not
able to take evasive action to avoid a collision and did not know the object he hit was a person until he
stopped ~ o t out to investigate. Due to the above stated facts, Trooper DISTASI was not able
to a v o i d ~ h o was illegally walking in the middle of the roadway. Trooper DISTASI was
operating 3F28 in the proper portion of the roadway, that being the south lane of North Road. This
accident is determined to be non-preventable on the part of Trooper DISTASL I recommend this
investigation to be closed with qo further action taken.

Introduction
On August 14, 2018, at approximately 8:45 A.M., I, Trooper Kyle M. Markle of
the Troop F Collision Reconstruction Unit (F-CRU), was contacted by New York State
Police Senior Investigator Paul Langowsky of the Troop F Forensic Identification Unit (FFrU), and was requested to respond to the scene of a vehicle (3F28) - pedestrian injury
collision involving marked New York State Police vehicle 3F28. The collision occurred
on North Road in the Town of Lloyd, Ulster County, New York.
I arrived at the collision scene at approximately 9:45 A.M. New York State Police
personnel on scene consisted of Inspector Robert C Gregory, Major Pierce V. Gallagher,
Captain Michael J. Drake, Captain Lawrence A. Muller, Captain Brian J. Shortall,
Lieutenant Peter J. Cirigliano II, Lieutenant Reva J. Navarro, Lieutenant Michael W.
Sum.nick, and Sergeant Station Commander John J. Fisher. I was assisted at the scene by
Senior Investigator Michael J. MacIntosh of the Troop H Collision Reconstruction Unit
(H-CRU), Investigator Brian L. Hunter (F-CRU), Investigator Adam B. Maillet (F-CRU),
Trooper Thomas G. Brennan (F-CRU), and Senior Investigator Langowsky. The weather
at the time of the investigation was cloudy skies and an air temperature of 72 degrees
Fahrenheit. The road surface was reported to be wet at the time of the collision and
remained that way throughout the on-scene investigation.
Summary
I was briefed by Senior Investigator Langowsky, who advised me that the
preliminary investigation revealed that at approximately 5: 58 A .M., Vehicle# 1, New York
State Police unit 3F28, a 2015 Ford Taurus, was traveling southbound on North Road. The
operator of Vehicle #1 was identified as Trooper James L. Distasi with a date of birth

roadway. Vehicle #1 struck
with the left front fender and headlight assemb!ly. After being struck, ubsequently strikes the lower left comer of the winds:hield, driver side "N' pillar,
side mirror and spot light with his upper body. Following the collision, Vehicle #1 came
to a position of controlled final rest within the southbound lane of travel. After being
struck,- . , . ,as projected and came to a position of u:n-controlled final rest in a
grassy area adjacent to the northbound lane of travel. - ·was transported to MidHudson Regional Hospital in Poughkeepsie, New York for medical treatment. The
operator of Vehicle #1 was transported to First Care Walk- In Medical Center in Highland,
New York for medical treatment.
Trooper Brennan pHotographed the scene documenting its condition at the time of
the investigation. The roadway was checked for any defects or items that might have
contributed to the collision. No such defects or items were observed. Investigator Hunter
forensically mapped the scene of the collision utilizing a Leica TCRP 1205+R400
Electronic Total Work Station (Serial #265500). Investigator Maillet forensically mapped
the scene of the collision utilizing a DT Research GPS Workstation (Serial
#0T7IT9611825008). I took aerial photos uti lizing CRU (UASF-6) DJI Phantom 4 Pro
(Serial #189CEBEBA20914).
A search using the Bosch Crash Data Retrieval Tool (Version 17.8) indicated that
Vehicle #1 was supported by the software.
On August 14, 2018, Investigator Hunter imaged the data from Vehicle #1, which
was located at the scene of the collision. An analysis of the umaged data from the Airbag
Control Module (ACM) of Vehicle #1 indicated that no event had been recorded.

North Road, in the area of the collision was an unlit, two-lane, individual flow
roadway oriented in a southwest-northeast direction. For report clarity, the roadway
direction will be described as it if were oriented south to north. There was no centerline
marking on the roadway to divide southbound and northbound traffic. The roadway was
constructed of asphalt and was moderately traffic polished. The area surrounding the
collision scene consisted of a wooded area to the east and west, along with several
residential properties to the south. The roadway in the area of the collision curved to the
left, and there was no pedestrian signage or roadway paint designating a pedestrian
crosswalk or regulated ·crossing are~. (Refer to attached scaled diagram for scene

to have reflective properties. The possibility of
being seen walking in the
middle of the roadway by the operator of Vehic e
was so hindered by the lack of
artificial ambient light, as well as the weather conditions at the time of the collision. The
only source of artificial ambient lighting in .the area was located on the east side of the
roadway several hundred feet south of the colJision scene. The weather at the time of
collision was reported to be foggy with cloudy skies, and a wet roadway.

The primary contributing factor for this collision, as it relates to the a n a lof

sub·ect matter surrounding this investigation was pedestrian error on the part of
or walking in th~ roadway. Additional consideration should be given to
lack of reflective clothing, the lack of artificial ambient lighting in the area, as
well as the adverse weather conditions present at the time of th«: collision. All of which
would have bad an adverse effect on the view out of the front windshield that the operator
of Vehicle #1 would have experienced prior to the collision.
A fu11 reconstruction will not be completed. All notes and information will be
retained on file with the Troop F Collision Reconstruction Unit
